Welcome to the University Solicitor's Office

Our Role

The University Solicitor's Office provides legal advice and services to management and staff of the University to ensure the effective implementation of University policies, and compliance with external legislative requirements (such as copyright, privacy and corporations law) and to support the smooth operation of the University's research activities and management processes.

The University Solicitor's Office:

  • reviews, advises, negotiates and drafts in relation to all manner of contractual arrangements involving University activities, assets, facilities and services, and research, research funding and research collaboration;

  • drafts all University Statutes and Regulations;

  • acts for the University and may act for a staff member who is named as the respondent to a complaint e.g. to the Ombudsman or the Victorian Human Rights and Equal Opportunity Commission and Federal equivalent in respect of a work related action;

  • advises on and represents the University in disputes and litigation;

  • provides advice to faculties on issues of administrative law arising in relation to the University's exclusion, discipline and grievance processes or from teaching activities such as a practical placement;

  • reviews all subpoenas for production of University records, which documents should be referred to the Solicitor's Office as soon as they are received.

Personal matters: students and staff

The University Solicitor's Office does not provide legal advice to students.  Neither does it advise staff on personal matters, including personal consultancies undertaken in accordance with the Monash University Practice and Paid Outside Work Policy.

For advice on personal legal matters students may consult a student rights officer (all campuses), staff may consult their union and/or students and staff may consult the Monash-Oakleigh Legal Service, Clayton, or other legal adviser.
